Are the following items to be forfeited if the employee is dismissed?
1. Earned annual leave
2. Overtime work
3. Allowance
4. Public Holiday Leave in lieu
Only earned annual leave will be forfeited in accordance to Employment Act, overtime work and allowance cannot be forfeited.
However, Public holiday off in lieu is to be looked upon differently from annual leave entitlement. As such, you cannot forfeit his public holiday off in lieu but it should be encashed.
